  • General Information:

    • The EB3 category is for skilled workers, professionals, and other workers (non-technical or unskilled).

    • A U.S. employer must sponsor the applicant and obtain a labor certification from the U.S. Department of Labor (DOL).

    • The employer files Form I-140 (Immigrant Petition for Alien Worker) with USCIS.

    • The applicant must file Form DS-260 (Immigrant Visa Application) and attend a consular interview.

  • Processing Time:

    • Labor certification can take several months.

    • I-140 processing time varies but is generally 4-6 months (premium processing is available for faster approval).

    • Visa availability depends on the applicant's country of origin and the visa bulletin's priority date.

  • Outcome: Permanent residency (Green Card) in the U.S.

EB5 Investment-Based Immigration

  • General Information:

    • The EB5 program requires a minimum investment of USD 800,000 in a Targeted Employment Area (TEA) or USD 1,050,000 in a non-TEA.

    • The investment must create at least 10 full-time jobs for U.S. workers.

    • The applicant files Form I-526 (Immigrant Petition by Alien Investor) with USCIS.

    • After approval, the applicant applies for a conditional Green Card (Form DS-260 and consular interview).

    • After 2 years, the applicant files Form I-829 to remove conditions and obtain permanent residency.

  • Processing Time:

    • I-526 processing can take several years due to backlogs.

    • Conditional Green Card is issued for 2 years.

  • Outcome: Permanent residency (Green Card) in the U.S.
